School Construction

In bullet #9 of the April 9 guidance from Empire State Development, it states that school districts are allowed to continue construction projects. However, to the greatest extent possible, local governments should postpone any non-essential projects and only proceed with essential projects when they can implement appropriate social distancing and cleaning/disinfecting protocols. Essential projects should be considered those that have a nexus to health and safety of the building occupants or to support the broader essential services that are required to fulfill the critical operations of government or the emergency response to the COVID-19 public health crisis.

Guidance from the New York State & Local Retirement System

NYSLRS advises its members who become seriously ill from the COVID-19 virus to file for retirement. This would allow an ongoing pension benefit to such person's beneficiary. Please click here to find the application appropriate for you. Employers can submit completed forms using Retirement Online.

Important Information Regarding Building Inspections

At this time, Building Code Enforcement has been deemed an essential service per Executive Order 202.6, and the NYS Dept. of State has affirmed this requirement. Therefore, the NYSED Office of Facilities Planning does not have authority to waive the requirement for the inspections necessary to maintain Certificates of Occupancy for school buildings required by statute and regulation.

Boiler Inspections

Thank you to NYSIR for informing us that Matthew Sansone, Chief Boiler Inspector New York State, is approving Boiler Certificate Extensions for a period of 90-day increments. If your district needs an extension for a boiler inspection, please email your request to Mathew.Sansone@labor.ny.gov including the name of the location, contact person, phone number and a list of the boilers that are affected, e.g. (NYxxxxxxL) for low -pressure boilers or (NYxxxxxxH) for high-pressure boilers.

Please make every effort to complete inspections, especially for any occupied buildings that are used for food prep/distribution, child care/day care activities or other occupied use. Fire safety inspections will need to be conducted, non-conformance identified, and data entered into the portal. If additional time is needed to correct any non-conformance, the portal may issue a temporary Certificate of Occupancy if allowed. The NYSED Office of Facilities Planning will also work with districts to grant additional time, as needed, to address any non-conformance found during the inspections.
